Commercial Use License

This Commercial Use of Art License (License) permits use of licensed images in a commercial capacity subject to the following terms and conditions. This license applies when an image is used commercially without the purchase of a Virtual Staging Package.

1. TERM
   This License is valid for one-time use for a period of 120 days.
2. PERMITTED USE
   The use of any image covered by this License shall be limited to inclusion in listing photos on the MLS and other online real estate listing websites in connection with marketing a specific real estate property.
3. ADDITIONAL USE
   Any additional use of images in printed materials shall require additional fees and an additional License. Such fees for additional image usage shall be negotiated based on the type of media or reproduction, extent of distribution, and duration of use of images. Contact 1ArtCollection.
4. COPYRIGHT OF IMAGES
   1ArtCollection.com hereby represents and warrants that it has acquired, from all image copyright holders, the rights to license, sublicense, sell printed reproductions, and use images in marketing and promotional capacities including, but not limited to, reproduction of copyrighted images in online and offline media, on its websites, in email and other online media, and in printed marketing and sales materials.
5. INFRINGEMENT OF COPYRIGHT
   Any use of licensed images beyond the terms of this License shall be construed as an infringement of copyright and subject to legal action by 1ArtCollection.com and/or the original copyright holders.
6. GOVENING LAW
   The validity, construction and enforceability of this License shall be governed in all respects by the laws of the State of Hawaii. 
7. WAIVER OF CONTRACTURAL RIGHTS
   This License may not be amended, except in writing, signed by 1ArtCollection.com. The failure of 1ArtCollection.com to enforce its rights under this License at any time for any period shall not be construed as a waiver of such rights.
8. FULL & FINAL AGREEMENT
   The terms and conditions set forth herein constitute the entire License agreement between the parties and shall supersede all prior agreements.
